The following rules of the affiliate program agreement are mutually accepted and applicable to all partnerships between the website Dobybet.com and the affiliate partner.
The affiliate partner, by registering to the affiliate program, accepts the following rules of the affiliate program agreement:
1. Dobybet.com gives the opportunity to website owners and administrators to advertise Dobybet.com's products. The prospective affiliate partner can sign up for free to Dobybet.com's affiliate program, thus concluding a affiliate program agreement to the mutual benefit of both parties. Signing of the agreement in physical form is not necessary. The affiliate partner by completing the registration accepts and signs the e-contract.
2. This cooperation could not be exclusive. Dobybet.com reserves the right to choose the advertising websites and to reject those who conflict with moral, economical or legal factors.
3. Dobybet.com would provide to the Affiliate a number of advertising means (logos, banners, graphics etc) giving the opportunity to the Affiliate to offer to his website users the chance to have immediate access to Dobybet.com's web site, by clicking on any of those advertising means. Through predifined codes of those advertising means, Dobybet.com's registration system would recognise incoming clients from the Affiliate's web site. Dobybet.com reserves the right to alter, limit or provide new advertising means anytime, without prior notice. Those advertising means are copyrighted and usage or reproductions without Dobybet.com's permission is prohibited.
4. As a return, for integrating those advertising means, the Affiliate would get commission which would be a part from the revenue share of his Active Users for the previous month, as it refers in Dobybet.com's Commission Program. Revenue share does not include bonuses and miscelaneous Dobybet.com advertising actions.
5. Active Users, are Dobybet.com's who:
a) Do not already own a Dobybet.com account.
b) Register to Dobybet.com using the advertising means which are placed inside Affiliate's web page or use Affiliate's Code.
c) Have deposited funds to their account at least one time, in a period of 30 days after inital registration.
d) They bet or use another Dobybet.com product, at least one time each month.
6. The Affiliate would not receive commission and the comercial cooperation would end, if Dobybet.com finds the one of the following fraudulent actions have commited:
a) Fraudulent activities of Active Users including, without limitation, the following:
• Invalid personal information.
• Minors.
• Transfer funds to accounts of other players.
• Money laundering.
• Same credit card use.
• Possession and use of more than one account.
b) Fraudulent activities of Affiliates include, without limitation, the following:
• If the Affiliate is also registered as an Active User.
• If the Affiliate and an Active User share the same IP address or the same computer.
• Multiple registrations from a specific site within a short time.
If Dobybet.com discover a fraud attempt against it, it will contact the Affiliate directly for the nature of the fraud and the Affilite have the obligation to rectify the situation within 24 hours from the notice. If not, Dobybet.com reserves the right to shut down Affiliate's account, including his Active Users, as also the access to his wallet. Dobybet.com reserves the right to hold any money from Affiliate's wallet, after the discovery of a fraud attempt.
7. An Affilite, in order to have the right to withdraw his commission, must have at least 5 (five) Active Users on his behalf, at least one banner on each page-subpage and the total commission amount should be greater than 100 EUR. In a different situation, the Affilite does not have the right to make a withdraw and his money are transfered to next month's balance. If after a period of 3 months from inital registration date, an Affiliate could not be able to withdraw his commission, his account would be shut down automatically, putting an end to the comercial cooperation and he looses the ability for any further commission withdraw. The same shall apply if in a period of 3 months, no 12(twelve) new Active Users exists.
8. If previous month commision of an Affiliate is negative, this means that his Active Users are gaining more than they loose. In this case, the negative commission shall be transfered to next month's balance. If an Affiliate's balance is negative for more than 3 months, Dobybet.com reserves the right to disable his account.
9. Previous month commission is credited monthly to Affiliate's wallet, withing the 5 (five) first days of each month. Affiliate from his side have the right to ask a commission withdraw ONLY between the 5th and the 10th day of each month. In any other case, the withdraw will be canceled.
10. The duration of the contract is indefinite and may be terminated at any time by either party by written notice of termination of the contract.
11. Dobybet.com reserves the right to modify the rules of this contract without prior notice to its affiliate partners. The affiliate partner is required to read the contract rules regular to determine any changes.
12. Dobybet.com reserves the right to transfer the obligations and rights deriving from this agreement between Dobybet.com and the affiliate partner to a third company which has undertaken to promote Dobybet.com's trademark.
13. Dobybet.com reserves the right to disable immediately an affiliate partner account and to withhold any amount of his balance, after prior notice to the affiliate partner, if after investigation a fraud attempt is revealed, whether or not listed in any paragraph of this contract. After the expiration of the affiliate partnership, the affiliate partner must cease any activity related to the promotion of the products of Dobybet.com and shall not use or disclose any promotional means or information of Dobybet.com for its own purposes. None of the Parties shall be responsible nor considered to violate or do not comply with the rules of this contract, if any violation, failure or non-compliance is due to force majeure, eg disaster, war, terrorism, conflict of laws etc.
